General
aussiewebart will carry out work only where an agreement is provided either by e-mail, telephone, mail or fax. aussiewebart will carry out work only for clients who are 18 years of age or above. An 'order' is deemed to be a written or verbal contract between aussiewebart and the client; this includes telephone and email agreements.

Customers Property
Customers property when supplied to aussiewebart will be held at the risk of the Customer, although all reasonable care will be taken to prevent loss or damage. If 3rd parties are sub contracted by aussiewebart and are to use this artwork to complete their requested task, then all artwork remains the property of the aussiewebart customer and may not be copied or used in any manner by the 3rd party for their own works outside of aussiewebart. Once the job has been completed all copies of the artwork either hard or soft are to be returned to aussiewebart or be completely deleted from their systems or servers.

Initial Work
Work produced, whether experimentally or otherwise, at Customer request will be charged for unless otherwise agreed in writing. If the Customer wishes to terminate an order at this stage, a termination invoice will be drawn up charging for time and materials up to this point.

Payment
A payment will usually be taken when work begins. Invoicing may be split into agreed phases in the event of lengthy jobs. The final payment will be taken upon completion of finished artwork. Divided payments by standing order may be considered under certain circumstances such as regular consultancy or administrative work..

Terms
All payments must be made before the invoice due date, unless agreed otherwise. Prices quoted by aussiewebart are inclusive of GST which will, where appropriate, be payable by the Customers. Where Hosting invoices are overdue by 30 days aussiewebart reserves the right to lock all email facilities; at 60 days the web site may be closed; at 90 days legal proceedings may commence.

Non-Payment
Failure by the Customer to meet financial obligations may result in legal proceedings by aussiewebart under which circumstances ALL legal costs and other administrative expenses will be recoverable in full by aussiewebart.

Web designs
aussiewebart cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

The website, graphics and any programming code remain the property of aussiewebart until all outstanding accounts are paid in full

Once a website has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, i.e If the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Non payment will result in legal action being taken if necessary. Once full payment is received for a website, it is assumed that the project has been completed to the clients satisfaction and no refunds can be offered.

Compatibility
aussiewebart will endeavor to ensure that any developed/designed site or application will function correctly on the server it is initially installed in and that it will function correctly when viewed with the web browsing software Microsoft Internet Explorer and to an acceptable level with Mozilla browsers. aussiewebart can offer no guarantees of correct function with all browser software.

Your Privacy
We do not share or sell any of your details with third party companies, without your express permission and we will only email you or contact you about work related matters.

Complaints Procedure
Informal procedure
Anyone who experiences a problem with their web service provided by aussiewebart should raise the matter directly using our online contact us to do so, giving sufficient information to locate the material (such as an url) and clearly outlining the grounds for complaint.

aussiewebart will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.

Formal complaints procedure
The formal complaints procedure should only be used where the complainant feels that the nature of the complaint is too serious to be dealt with informally, or where a satisfactory conclusion has not been reached after following the informal procedure.

A formal complaint should be made in writing to aussiewebart, who will acknowledge receipt and ensure that the matter is looked into as soon as possible.

An initial response to any complaint can be expected within seven days of its receipt; a full and considered response to the complaint should be completed within 30 days and any subsequent remedy implemented with the minimum of delay.
